Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and Kathleen Loving Harner, an individual sole trader operating from Pennsylvania, United States, trading as SteadyPath ("SteadyPath", "we", "us" or "our"). By creating an account, accessing the program, or otherwise using SteadyPath, you agree to be bound by these Terms.
1. The service
SteadyPath provides a 6-week online video program of gentle daily movement lessons for seniors, together with related written summaries, community discussion, progress tracking, and customer support (the "Service"). You must be at least 18 years old and legally able to enter into a binding contract to use the Service.
2. Your account
You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us through the Support pageimmediately if you believe your account has been used without your permission.
3. Payment, billing and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refund mechanics are governed by the Paddle Buyer Terms.
Refund requests are handled under our Refund Policy.
4. Licence to use the Service
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal, non-commercial use. You may not:
- copy, redistribute, resell, sublicense, or publicly display the videos or lesson materials;
- reverse engineer, decompile, or attempt to extract the source code of the Service;
- circumvent any access controls, rate limits, or other technical measures;
- use the Service to build a competing product or dataset.
5. Acceptable use
You agree to follow our Acceptable Use Policy, which prohibits, among other things, unlawful use, harassment of other members, spam, scraping, infringement of intellectual property, uploading malware, and interfering with the security or integrity of the Service.
6. User content and community
The Service includes areas where you can post comments, questions, and other content ("User Content"). You retain ownership of your User Content. By posting, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your User Content solely for the purpose of operating and improving the Service. You are solely responsible for your User Content and represent that you have all necessary rights to post it.
We may, but are not obligated to, review, moderate, or remove User Content that we reasonably believe violates these Terms or the Acceptable Use Policy.
7. Intellectual property
The Service, including all video lessons, written content, software, and branding, is owned by Kathleen Loving Harner (SteadyPath) and is protected by copyright, trademark, and other intellectual property laws. Except for the licence granted above, no rights are transferred to you.
8. Health disclaimer
SteadyPath is a general fitness and wellness program, not medical advice. Please read our Disclaimer carefully before beginning any exercise in the program.
9. Service availability
We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, if:
- you materially breach these Terms or the Acceptable Use Policy;
- your payment is unsuccessful and remains unpaid after reasonable notice;
- we reasonably believe your account has been compromised or is being used for fraud;
- we are required to do so by law.
You may stop using the Service at any time by canceling your subscription and, if you wish, deleting your account from the Account page.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service will not exceed the amounts you paid to us (via Paddle) in the twelve (12) months before the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill. Nothing in these Terms limits liability for fraud, personal injury, or death caused by our negligence, where such limitation is not permitted by law.
12. Indemnity
You agree to indemnify and hold SteadyPath harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.
13. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use after the changes take effect constitutes acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-laws principles. You and SteadyPath agree that any dispute will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to their personal jurisdiction.
15. Assignment and force majeure
You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party will be liable for delays caused by events beyond its reasonable control.
